Dominion Voting Systems hired private investigators and tracked the pro-Trump attorney Sidney Powell across state lines after she evaded service of a massive lawsuit for “weeks,” attorneys for the voting machine company claimed in a Tuesday filing.
Powell was ultimately served late last month, but only after an alleged chase of sorts that an attorney for Dominion, Tom Clare, detailed in the filing.
“Powell evaded service of process for weeks, forcing Dominion to incur unnecessary expenses for extraordinary measures to effect service, including hiring private investigators and pursuing Powell across state lines,” Clare wrote.
An attorney for Powell, Howard Kleinhendler denied to TPM that Powell had evaded service and said she looks forward to “defending herself in court.”
“Ms. Powell did not evade service,” Kleinhendler said. “She regularly travels as part of her work and stays at different locations. Unfortunately, for the past several months Ms. Powell has had to take extra precautions concerning her security and this may have caused opposing counsel to have more difficulty with service.”
Dominion is suing Powell and others as part of a massive legal effort over what the voting machine company says were months of defamatory claims that Dominion machines had helped rig the 2020 election for Joe Biden.
Dominion is seeking $1.3 billion in compensatory and punitive damages from Powell. It’s also sued Trump lawyer Rudy Giuliani and has others in its sights.
Clare’s filing affirmed that Dominion did not object to allowing Powell more time to respond to the Dominion complaint.
